Please read this Privacy Policy (the “Policy”) carefully to understand our policies and practices regarding your information and how it’s collected and treated when you visit flovisionsolutions.com (together with related applications, including content, functionality, and services offered through the same, and specifically including FloVision Analytics, the “Website”). Within this Policy, “you” or “Visitor” means a user of the Website, and “we”, “us”, “our” or “FloVision” refers to FloWaste Inc. dba FloVision Solutions, a Delaware corporation.
This Policy describes how we collect, use, and disclose personal information and other types of information in connection with our Website. It applies to all visitors to our website, including individuals who submit inquiries, request demonstrations, or otherwise engage with our publicly available resources (except as may be limited by a Commercial Services Agreement, described below). By accessing or using the Website, you agree to this Policy. If you do not agree with our Policy and practices, your choice is not to use the Website.
Where an enterprise customer (“Customer”) has entered into a master services agreement or other written agreement with us governing the use of our platform (a “Commercial Services Agreement”), the Customer (i.e., your employer or the organization for which you are a contractor, advisor, etc.) will remain the “controller” of that information or the “business” processing such information under certain consumer data privacy laws (while FloVision is the “service provider” or “processor” as applicable). In the event of any conflict between this Policy and the terms of a Customer’s Agreement as they relate to the processing of end user data, the Commercial Services Agreement will control.
We reserve the right to change this Policy at any time. Such changes, modifications, additions, or deletions shall be effective immediately upon notice thereof, which may be given by means of posting a notification on this Website or by other means if required by law. We may make non-substantive updates or clarify existing provisions without notifying you, where allowable by law. It is your responsibility to review Website and this Policy periodically and to be aware of any modifications. Your continued use of the Website after such modifications will constitute your acknowledgment of the modified Policy and you agree to be bound by the modified Policy.
(a) We may collect certain information from you that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to, a particular person or household, such as your name, email address, phone number, and company name (collectively “Personal Information”). We collect Personal Information from you when you provide it to us, including when you contact us via a webform on the Website or when you create an account, if applicable.
(b) We may also collect information about your use of the Website, and other information to operate the Website (“Usage Data”). This may include information regarding how the Website is accessed and used by you (including but not limited to browser type, browser version, the pages of our Website that you visit, the time and date of your visit, the time spent on those pages, and/or whether your Website visit or form submissions are attributable to our advertising efforts). Certain Usage Data is collected for every Visitor of the Website. We may associate Usage Data with a unique identifier or with Personal Information about you in our internal systems. Usage Data may be collected automatically as you visit and navigate through the Website, and we may also engage third party service providers to obtain Usage Data on our behalf, subject to their own policies as described in Section 4 of this Policy.
We may use your information in the manners set forth below (unless a Commercial Services Agreement applies and provides otherwise). In this Policy, the term “information” includes all information we collect or obtain about you, including Personal Information and Usage Data, unless otherwise specified.
(a) We will use your information to operate the Website, perform or fulfill services requested by you, to deliver information to you about our products and services (including advertisements), to analyze how you use the Website, to improve and tailor our products and services, and to inform you of changes to our Website or our policies when notice is required by law.
(b) We may use, reproduce, copy, and publish, and you hereby grant permission for us and our licensors to use, reproduce, copy, and publish information which is or has been de-identified, anonymized, and/or aggregated such that it is no longer capable of identifying you (“Aggregated Data”). Aggregated Data may be derived from your Personal Information and Usage Data (which for the avoidance of doubt includes all information and responses you may provide on the Website). We may use Aggregated Data for any lawful purpose, including for our marketing purposes, and for continuing to develop our software and our Website generally.
(c) We may use your information for any other specific purpose that we communicate to you upon collection of the same, and for any purpose that you approve or for which you direct us to use such information.
We will not sell your Personal Information. We may disclose information as set forth below (unless a Commercial Services Agreement applies and provides otherwise):
(a) We may disclose your information with our subsidiaries and affiliates, and with contractors, service providers, and other third parties who we have engaged in order to continue to develop and improve our services. For example, we may disclose your information to IT service providers that support Website features and functionality, or to service providers, such as but not limited to Google, LinkedIn, and HubSpot, that help collect Usage Data and provide you with advertisements by using cookies and other technologies (as discussed further in Section 6).
(b) We may provide Aggregated Data to third parties, for or without consideration.
(c) We may disclose your information as part of a transfer or assignment if we are acquired by, sold to, or merged with another entity, or otherwise reorganized or liquidated, provided that, if in connection with such sale, merger, or other reorganization, the collection, use, or disclosure or your information will differ from this Policy, you will receive a notification of the same as provided herein above.
(d) We may disclose your information in response to legal processes, court orders, or government or regulatory requests; to enforce other agreements with you, including for billing and collection purposes; and if we believe disclosure is necessary or appropriate to investigate, prevent, or take action regarding illegal activities, suspected fraud, unauthorized use of third party rights, situations involving potential threats to the physical safety of any person, violations of this Policy, to verify or enforce compliance with this Policy and applicable laws, or as otherwise required or permitted by law or consistent with legal requirements.
(e) We may disclose your information as appropriate to protect us, other Visitors, and third parties if we believe that you may harm, or have harmed, the property or rights of FloVision Solutions, other Visitors, or any other third party, to report, disclose, limit, respond to, or prevent such conduct or activity.
If you use the Website on behalf of a Customer, we may provide the Customer with the personally-identifiable information that you used to create your account, and we may also share Usage Data or other use metrics with the Customer, in our capacity as a processor or a service provider to the Customer. The Customer on whose behalf you access the Website may choose to terminate your access at any time (or we may terminate your access without terminating a Commercial Services Agreement where such agreement may allow).
Unless a Commercial Services Agreement applies and provides otherwise, and except where limited by applicable law, information may be obtained from you through the use of cookies. Cookies are files with a small amount of data which may include an anonymous unique identifier. We may make cookies available to give you the best online experience possible. The cookies we use do not contain personally identifiable information and are initially used to determine whether your browser accepts cookies; however, once you choose to enter personally identifiable information on the Website, that information may be linked to the data stored in the cookie so that you do not have to provide it when you revisit the Website. The Website also uses cookies and other technologies offered by third-party service providers including, but not limited to, Google, LinkedIn, and HubSpot (Third-Party Tools). Such Third-Party Tools include tags, tracking pixels, and web beacons that are used to collect and analyze Usage Data, provide you with advertising, and measure the effectiveness of advertising campaigns. You may be able to disable cookies and other technologies, including Third-Party Tools, through your web browser or via other means, but in such case, we may not be able to provide to you some of the features and functionalities otherwise available via the Website, or your Website experience may change.
This Policy applies to every Visitor. The Website is intended for use only by individuals over the age of 18. We do not knowingly collect Personal Information from children under 18. If you become aware that a child under 18 of whom you are the parent or legal guardian has provided us with Personal Information, please contact us. We will take steps to delete any Personal Information provided to us by that child.
You may choose to update or delete certain information that we may have about you by contacting us at info@flovisionsolutions.com. If you delete certain information, or decline to share certain information with us, we may not be able to provide to you some of the features and functionalities otherwise available via the Website, including if you are accessing the Website on behalf of a Customer.
We may retain your Personal Information for the following periods, unless a Commercial Services Agreement applies and provides otherwise: (i) for a period of time necessary to provide any services you have requested; (ii) for as long as necessary to comply with any legal requirement, to protect our legal interests, or otherwise pursue our legal rights and remedies; and (iii) on our backup and disaster recovery systems in accordance with our backup and disaster recovery policies and procedures. In addition, we may retain your email address to send you updates and offers from FloVision Solutions, unless and until you unsubscribe or opt out from the same (or unless a Commercial Services Agreement applies). As to Aggregated Information and Usage Data, we may retain the same indefinitely.
This Policy only applies to information collected by our Website. Other sites or content accessible on or through our Website from time to time, such as videos, images, and articles (“Third-Party Content”) may have their own privacy policies and data collection, use and disclosure practices. When you engage with Third-Party Content, such content may enable cookies and other tracking technologies (that FloVision Solutions and the Website do not control) to monitor your interaction with the Third-Party Content. We are not responsible for the policies or practices of third parties. You should contact those third parties directly and consult each site’s policy if you have any questions about their policies and practices regarding your information.
(a) In the United States, depending on your state of residence, and subject to certain exceptions, you may have some or all of the following rights:
(b) To submit a request to exercise your rights set forth in this Section 11, and as applicable, to appeal a consumer rights action, you may use info@flovisionsolutions.com. We may require that you verify your identity to respond to your request. If you are entitled to a substantive response, we will deliver the requested information to you within 45 days (or will inform you that an extension of such timeframe is necessary). You may make a request up to twice during a 12-month period. We will not discriminate against you for exercising your rights pursuant to applicable state laws.
(c) If we collect Personally Identifiable Information from you when you create an account to access the Website on behalf of a Customer (i.e., your employer or the organization for which you are a contractor, advisor, etc.), please reach out to your organization’s administration regarding processing of your data under any Commercial Services Agreement and exercising your rights under applicable state law. FloVision will cooperate with the Customer to facilitate any such requests as required by applicable law and any Commercial Services Agreement.
